Back linking, copyright and fair use

It's a bad day for the web when a high court makes a judgement making headlines and excerpts from news articles not fair use. This actually happened in England this week. But mind you we cannot be surprised by the folly of the courts in a country where toy pigs were banned from council buildings because they offend the sensibilities of a religion. Miss Piggy is not just a fun cartoon character in England, she is a dangerous anti muslim beast, but that is not the point of this story we are talking about backlinks, copyright and fair use. It has always been considered fair use to use an extract from someones writing as an attributed quote to make your point. In order to strengthen an argument various sources may be quoted and linked to. On the web it is considered good manners when attributing another's work to hyperlink to it. So if I for instance quoted the Times in an opinion peace or blog I would add a link to the article I was quoting. This is good for the times for more than one reason. As any SEO practitioner will tell you links bring readers from other websites, add to your Google PR by adding authority. On the web fair use give advantage to the website being quoted. The High Court in England has banned the use of headlines and extracts exceeding 256 characters as fair use. The Big media do not want bloggers stealing their content and using it even in exchange for the backlinks. So forthwith I shall forever more ensure that I do not use any of their content, I shall never again link back. If I do reference them I will add a notation with no anchor link. The article that lead to this opinion piece was not from a major media site and will be referenced even though I did not actually use any of their words on my page. I love linking to others work because it spreads knowledge. You should too.

By the way, many newspapers seal bloggers'content without linking back or quoting them. Some publishing houses and travel guides do it as well. The bloggers who don't quote properly are to blame as well.
